Did you know DPA 1998 has been replaced?

It seems that with all the hype about the GDPR, the DPA 2018 continues to be overlooked and businesses are failing to be aware of the Act and how it affects them.

During our work we often see businesses stating they are GDPR compliant yet still referring to the Data Protection Act 1998, this shows a lack of knowledge and understanding of the new regulations and reduces the credibility of the work you may have put in to your compliance.

The UK's third generation of data protection law received the Royal Assent and its main provisions commenced on 25 May 2018. The new Act aims to modernise data protection laws to ensure they are effective in the years to come.

What is the difference between the DPA 2018 and the GDPR?

The GDPR has direct effect across all EU member states and has already been passed. This means organisations will still have to comply with this regulation and we will still have to look to the GDPR for most legal obligations. However, the GDPR gives member states limited opportunities to make provisions for how it applies in their country. One element of the DPA 2018 is the details of these. It is therefore important the GDPR and the DPA 2018 are read side by side.

Another successful event

Another successful 1 hour GDPR Essentials overview delivered with Clarkes Consulting Ltd today at Eliot Park Innovation Centre for Warwickshire County Council.

As always we received some great feedback from all 30+ businesses that attended. Here is just some of the feedback we had today...

"we are a small business and we are really busy, can you come and put everything I need in place for me?" (the answer to that one is yes)

"can we book you to come and train our staff? (the answer to this one is also yes!)

"i came today because a friend recommended you and i'm so glad they did, the session was brilliant" "we need a data protection officer and it's too expensive to employ one in-house so it's great to know that we can outsource it to you as it;s much more affordable"
